These Terms of Service ("Terms") govern access to and use of the website yourpulse.io and the Pulse family of management software products, including Pulse BMS, Pulse GMS, Pulse HMS, Pulse DMS, and Pulse Clinic (together, the "Service"). The Service is owned and operated by PulseHub (SMC-Private) Limited ("Pulse", "we", "us", or "our"). By creating an account, subscribing to a plan, or otherwise using the Service, you ("Customer", "you") agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
Pulse provides subscription-based management software for residential buildings and societies (BMS), gyms and fitness studios (GMS), hostels and guest houses (HMS), inventory-driven businesses (DMS), and clinics and healthcare providers (Clinic). Each product includes the features and deliverables described on its respective pricing page at yourpulse.io/pricing, including the relevant subdomain pricing pages for Pulse DMS and Pulse Clinic. Feature sets, usage limits, and support levels vary by plan and are described at the point of purchase.
You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at hello@yourpulse.io if you suspect unauthorised use of your account.
New accounts may be eligible for a 7-day free trial. No payment is required to start a trial. If you do not cancel before the trial ends, your subscription will convert to a paid plan and billing will begin in accordance with the plan you selected.
Paid plans are billed on a recurring monthly or annual basis, as selected at checkout, and renew automatically until cancelled. Prices for each plan are published on our pricing pages and may be updated from time to time; changes will not affect a billing cycle already in progress.
Payments for subscriptions purchased through our checkout are processed by Paddle.com Market Limited ("Paddle"), our authorised reseller and merchant of record. Paddle handles payment collection, tax calculation and remittance, and invoicing for these transactions, and its own terms and privacy policy apply to the payment process. Purchases are subject to our Refund Policy.
Where a Pulse product (for example Pulse BMS) is used to record or facilitate payments between a Customer and its own end-users (such as residents, members, or tenants), those payments are made directly between the Customer and its end-users through third-party payment methods; Pulse does not process, hold, or take a share of those funds.
You may cancel your subscription at any time by contacting hello@yourpulse.io. Cancellation stops future renewals; it does not automatically entitle you to a refund for the current billing period. See our Refund Policy for details.
You agree not to use the Service to: violate any applicable law; infringe the intellectual property or privacy rights of others; upload malicious code; attempt to gain unauthorised access to the Service or other accounts; or resell, sublicense, or provide the Service to third parties outside your own organisation without our written consent.
You retain ownership of the data you submit to the Service ("Customer Data"). We process Customer Data solely to provide and improve the Service, in accordance with our Privacy Policy. You are responsible for the accuracy and legality of the Customer Data you upload.
The Service, including its software, design, and branding, is owned by PulseHub (SMC-Private) Limited and protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes for as long as your subscription is active.
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes to the Service from time to time, and will provide reasonable notice where a change materially affects functionality you rely on.
We may suspend or terminate access to the Service if you breach these Terms, fail to pay outstanding fees, or use the Service in a way that creates risk or legal exposure for us or other users. You may terminate your account at any time as described in Section 5.
To the maximum extent permitted by law, Pulse's total liability arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. Pulse shall not be liable for indirect, incidental, or consequential damages, including loss of profits or data, arising from your use of the Service.
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Pakistan, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Pakistan.
